采矿区天然气管道项目审批工作的思考

Consideration on the Examination and Approval Procedure of Natural Gas Pipeline Construction in Coal Mining Area

为避免或减少建设项目压覆重要矿产资源,提高矿产资源开采能力,保障建设项目正常进行,维护矿业权人的合法权益,2010年国土资源部下发《关于进一步做好建设项目压覆重要矿产资源审批管理工作的通知》(国土资发〔2010〕137号),要求管道建设项目在经过煤矿勘探开采区时,必须办理相关审批手续,天然气管道项目也在其中。这些手续的办理一般比较困难,有可能会涉及巨额赔偿,导致一些小规模天然气管道项目缺乏经济性而不能立项。本文结合天然气管道项目特点,说明了天然气比重比空气小,从管道泄漏出来后,将向上扩散到空气中,天然气管道项目的建设并不会对地下矿产开采产生影响,是否要压覆矿产资源、进行补偿应由管道企业选择决定。通过一些典型案例,说明了一些小口径、低压力、低钢级天然气管道项目在经过采矿区时隐患治理方案的多样性,以及管道企业和煤矿企业在不同情况下应该承担的责任义务等。根据这些成功的治理经验,建议适当简化天然气管道经过采矿区时的审批管理程序,尤其针对一些小规模天然气管道。

In order to avoid or reduce the overwhelming of important mineral resources by construction projects,improve the mining capacity of mineral resources,ensure the normal progress of construction projects,and safeguard the legitimate rights and interests of mining rights holders,in 2010,the Ministry of Land and Resources issued the"Notice on Approval Management Work of Regarding the Further Improvement of Construction Projects Overlaying Important Mineral Resources"(State Land Statement)requires that pipeline construction projects must go through relevant approval procedures when passing through coal exploration and mining areas,and natural gas pipeline projects are among them.It is generally difficult to handle these procedures and may involve huge compensations,resulting in some small-scale natural gas pipeline projects that lack economic efficiency and cannot be approved.Combining the characteristics of the natural gas pipeline project,this article shows that the proportion of natural gas is smaller than that of air.After leaking from the pipeline,it will diffuse upward into the air.The construction of the natural gas pipeline project will not affect the mining of underground minerals.Compensation should be determined by the pipeline company's choice.This article uses some typical cases to illustrate the diversity of hidden danger management solutions for some small-diameter,low-pressure,and low-steel natural gas pipeline projects passing through mining areas,as well as the responsibilities and obligations of pipeline companies and coal mining companies under different circumstances.Based on these successful governance experiences,it is recommended to appropriately simplify the approval and management procedures when natural gas pipelines pass through mining areas,especially for some small-scale natural gas pipelines.
