元宇宙中数字货币的包容性法律规制

Inclusive legal regulation of digital currency in the metaverse

元宇宙产业的日新月异给数字货币带来了全新的发展机遇,不仅使得数字货币作为“准货币”的职能予以凸显,还展现了其在资产确权方面的新职能。数字货币在元宇宙中流通的同时也挑战着国家货币主权,监管的缺位将可能损害投资者的合法权益,甚至引起系统性金融风险并传导至现实世界。作为一种新兴货币,数字货币的法律性质尚不明确,并且各国对其采取的法律规制手段存在差异,这使得传统的监管手段滞后于元宇宙的新发展。现阶段“一刀切”的监管方式无法满足我国数字经济发展的需要,应以包容性发展为理念,在现有基础上稳步推进中央银行数字货币,并加强国际间的监管合作,引导数字货币朝着规范、健康的方向良性发展。

The rapid development of the metaverse industry has brought new opportunities for digital currency.It not only highlights the function of digital currency as a“quasi-currency”,but also shows its new function in asset identification.The circulation of digital currencies in the metaverse is also accompanied by the weakening of national monetary sovereignty,and the lack of regulation may harm the legitimate rights and interests of investors,even cause systemic financial risks.As an emerging currency,its legal nature is still unclear and there are differences in the legal regulation among countries,which makes the traditional regulation lag behind the new development of the metaverse.The current“one-size-fits-all”regulatory approach cannot meet the needs of China’s digital economy development.We should adhere to the concept of inclusive development,steadily promote central bank digital currency on the existing basis,and strengthen international regulation and cooperation to guide the benign development of digital currencies in a regulated and healthy direction.
