The Development Path of Intellectual Property with Chinese Characteristics and the Self-Reliance and Self-Improvement of Science and Technology

科技自立自强是我国国情和实践发展的现实需求。从科技创新的全链条来看,科技的自立有赖于坚实的基础研究,科技的自强需要高效地进行应用研究和成果转化,实现科技自立与自强的统一则还需要可持续的科技创新循环。知识产权是保护科技创新的基础性制度。西方知识产权制度在当下呈现出一系列问题,我国对西方知识产权制度进行的扬弃,具体体现为破除唯财产权论的桎梏,打破治理理念的局限,以及修正全球治理的霸权主义。中国特色知识产权发展道路为基础研究提供政策引领和创新激励机制,为应用研究和成果转化提供确权保护和资源配置机制,为科技创新循环提供促进保障机制,从而发挥对科技自立自强的推动和保障作用。

Science and Technology self-reliance(STSR)and self-improvement(STSI)are the practical needs of China's national conditions.From the perspective of the entire chain of scientific and technological innovation,the STSR depends on solid fundamental research,and the STSI requires efficient applied research and achievement trans⁃formation,and achieving the unity of STSR and STSI also requires a sustainable scientific and technological innovation cycle.Intellectual property rights are the fundamental system for protecting scientific and technological innovation.The Western intellectual property system is currently facing a series of problems,making it difficult to provide compre⁃hensive theoretical support for China's scientific and technological innovation and development.China has developed the Western intellectual property system,which has been reflected in breaking the shackles limited to property rights theory,smashing the limitations of governance concepts,and correcting hegemonism in global governance.The devel⁃opment path of intellectual property rights with Chinese characteristics provides policy guidance and innovative incen⁃tive mechanisms for fundamental research,rights confirmation protection and resource allocation mechanisms for ap⁃plied research and achievement transformation,and promotion and guarantee mechanisms for the cycle of scientific and technological innovation,thereby exerting promoting and safeguarding the STSR and STSI.
