虚拟数字人IP化法律问题及其知识产权保护应对

Legal Issues and Intellectual Property Protection Measures for the IPization of Virtual Digital Human

虚拟数字人IP化是通过建模、驱动、渲染并植入人设而创设出的可版权化、可商标权化、可专利化等IP化的虚拟数字人知识产权数字化策略、方法与要诀。从虚拟偶像洛天依IP化成功的策略入手,反观数字形象IP原创性不足、同质化严重等共性问题,引申出在元宇宙场景中预构知识产权法律规制与保护、为虚拟数字人重置知识产权法律规制与保护等问题。在现行法律的框架内,给予元宇宙新型作品、“中之人”表演、粉丝社团、虚拟数字人的静态与动态形象等给予著作权、邻接权的立法赋权与授权,包括商标、专利范畴的相关权属的赋权,再予以司法或仲裁上的相应确权,是该文对于虚拟数字人IP化知识产权焦点法律问题的探讨与分析。结合法律难点问题,文章提出了对虚拟数字人版权保护与行业合规体系同步建设等知识产权保护的策略应对。

The IP digitization of virtual digital humans is a strategy,method,and key to the digitization of intellectual property rights of virtual digital humans that can be copyrighted,trademark copyrighted,and patented,created through modeling,driving,rendering,and embedding human designs.Starting from the successful strategy of virtual idol Luo Tianyi's IP,this paper reviews the common problems of digital image IP,such as insufficient originality and serious ho⁃mogenization,which leads to the problems of preconstructing the legal regulation and protection of intellectual property in the metaverse scene,and resetting the legal regulation and protection of intellectual property for virtual digital hu⁃mans.Within the framework of current laws,provide new works of the metaverse middle-person the legislative empow⁃erment and authorization of copyright and neighboring rights for performances,fan clubs,and static and dynamic im⁃ages of virtual digital individuals,including the empowerment of related rights in trademark and patent categories,fol⁃lowed by corresponding judicial or arbitration confirmation,are the focus of this article's exploration and analysis of the legal issues related to the IP based intellectual property rights of virtual digital humans.Combining legal difficul⁃ties,it also proposes the copyright protection and industry compliance system for virtual digital humans strategic re⁃sponses to intellectual property protection such as synchronous construction.
