多维证成与解读:我国作品署名推定条款的变革

Multidimensional Proof and Interpretation:The Reform of Presumption Rule of Signature of Works in China

伴随着《著作权法》第三次修订,我国作品署名推定条款迎来了变革。尽管理论界尚无定论,但将其解读为通过作品署名推定署名主体拥有作者身份并享有该作品的著作权,具备解决原有条款之间混乱以及履行国际条约义务的必要性,也能体现对署名揭示作者创作者身份等本土传统的合理继承,以及对各国吸收其他体系有益规定等域外经验的合理借鉴。同时,如此解读不仅在逻辑、理论和相关体系上具有可行性,而且因存在类似尝试,较为成熟稳定,契合我国的实践需要,所以也具有实践适用的可行性。纵使变革后的条款可能仍在条款表述和规则安排上存在着一定的不足,但瑕不掩瑜,其仍然是我国当下的适宜之选。

With the third revision of the Copyright Law,the presumption rule of signature of works in China has ush⁃ered in a change.Although there is no conclusion in the theoretical circle,it is interpreted as presuming that the signer has the identity of the author and enjoys the copyright of the work through the signature on the work.It not only has the necessity to solve the confusion between the original provisions and fulfill the obligations of international treaties,but also reflects the reasonable inheritance of the local tradition such as signature revealing the identity of the author,as well as the reasonable reference for the experience of foreign countries in absorbing the beneficial provisions of other systems.At the same time,this interpretation is not only feasible in logic,theory and related system,but also has the feasibility of practical application because of the similar attempt,which is more mature and stable and meets the practi⁃cal needs of our country.Even though there may still be some deficiencies in the clause expression and rule arrange⁃ment after the reform,it is still an appropriate choice for our country at present.
