法治建设需立法先行,实现善治需坚持良法。新时代中国的诸多变化对立法工作提出新的要求,如何提高立法质量是当前法治中国建设中不可绕开的根源性问题。深入推进科学立法、民主立法是破除立法质量不高之掣肘的根本途径,准确把握二者的核心要义是其逻辑基础,加强重点领域立法是其具体内容之一。本文旨在考察、梳理从“法治浙江”到“法治中国”的转型升级过程中,习近平总书记关于立法的重要论述,亦即习近平法治思想中的立法理论的形成脉络、思想精髓以及实践探索,以期有助于人们深入学习贯彻习近平法治思想。

The construction of the rule of law requires the legislation to go first,and good governance requires adherence to good laws.The many changes in the new era have put forward new requirements for legislative work,and how to improve the quality of legislation is a fundamental issue that cannot be avoided in the current construction of a law-based China.To further promote the sound and democratic legislation is the fundamental way to break the constraint leading to poor quality legislation:the logical basis is to accurately grasp the core of sound and democratic legistion,and strengthening legislation in key areas is one of the specific contents.This article is intended to examine and sort out the formation,ideological essence and practical exploration of General Secretary Xi Jinping s guiding ideology on legislation in the process starting from the proposal for a“Rule of Law Zhejiang”to the proposal for a“Rule of Law China”,in order to help deepen the understanding and implementation of the connotation of legislative principles.
