法治一体建设视域中的行政许可告知承诺制

Analyzing the Administrative License Notification Commitment System from the Perspective of Integrated Construction of Rule of Law

行政许可告知承诺制是一项试验于地方,由中央推广至全国的重要制度创新。在法治国家、法治政府和法治社会一体建设视域中,行政许可告知承诺制具有推动诚信社会建设、促进政府职能转变、助推营商环境优化的功能价值。然而,行政许可告知承诺制度的实施内含合法性危机,存在法律属性不明确、上位法规定不完善和信用监管机制不健全等问题。未来,在行政许可法修订时应将告知承诺制确立为行政许可的重要实施程序,并从明确告知承诺制的适用范围、强化告知承诺制的监管手段和厘清告知承诺制的法律责任三个方面进一步提升告知承诺制实施的制度效能。

The administrative license notification commitment system is a significant institutional innovation that has been trialed at the local level and promoted by the central government across China.In view of the integrated construction of China,Chinese government and society under the rule of law,the administrative license notification commitment system has the functional value of promoting the construction of an honest society,facilitating the transformation of government functions,and helping to optimize the business environment.However,the implementation of this system is currently facing a crisis of legitimacy due to such issues as unclear legal attributes,insufficient provisions in the upper-level law,and lack of a comprehensive credit supervision mechanism.In the future,it is essential to revise the Administrative License Law,which should be established as a crucial implementation procedure of the administrative license system.By doing so,the institutional effectiveness of the system can be significantly improved by clearly defining the scope of application of the system,strengthening the means of supervision,and clarifying the legal responsibilities of the system.
