论著作权法视域下用户创造内容的治理进路

On the Governance Approach of User-Created Content from the Perspective of the Copyright Law

知识与信息在全球互联网中的自由流动使原本被动接受信息的互联网用户群体正在逐渐转变为信息产品制造者。在这一背景下,用户在创造内容过程中使用他人作品之行为的合法性问题已然成为著作权法中亟待解决的法律问题。针对这一问题,文章认为著作权法治理方案应包含两个面向的内容:一是从解释论与立法论入手,为用户创造内容之行为寻找到一条可行的合法性解释路径;二是引入版权补偿金制度,以网络平台为支付主体,以著作权集体管理组织为收取主体与分配主体,进而平衡用户创造内容对著作权人的利益带来的负面影响。

The free flow of knowledge and information in the global Internet has gradually transformed the group of Internet users passive recipients of information in the first place-into producers of information products.Against this background,the legality of their implanting others’works in their con-tent has become a legal issue to be resolved in the Copyright Iaw.In response to the problem,the paper has proposed two countermeasures related to copyright law govermance scheme of user-created content:One is to find a feasible path of legitimacy for the behavior of creating content based on interpretive and legislative theories;second is to introduce a copyright compensation system,with the online platform as the main body of payment and the copyright collctive management organization as the main body of collection and distribution,thereby to neutralize the negative impact of user-created content on the interests of copyright owners.
