集体经营性建设用地使用权流转纠纷实证研究——基于2020—2021年259份典型司法案例分析

摘要 探究集体经营性建设用地使用权入市流转中的核心问题,为完善集体建设用地市场机制、实现城乡统一的建设用地市场提供参考。本文通过总结近两年来259份典型司法判例,采用扎根理论和判决书统计分析的方法,分析农村集体经营性建设用地使用权入市流转过程中纠纷形成的特征、诉讼理由和诉讼原因。研究结果:(1)农村集体经营性建设用地使用权流转方向多为农村集体经济组织将使用权流转给自然人或法人;(2)诉讼理由包括土地性质、土地权属和合同效力等;(3)诉讼原因主要在于相关监管制度不健全、规划的频繁调整,相关法律法规相对滞后,流转交易过程缺乏指引。研究结论:集体经营性建设用地使用权流转出现的纠纷大多都涉及行政机关,流转程序的完善是目前制度建设中值得探究的部分,其次是完善法律制度,保证法律的应用与社会发展同步是激发集体建设用地市场活力的重要手段。 This study explores the core problems in the circulation of collective-owned commercial construction land use right to provide relevant suggestions on improving the collective construction land market mechanism and realizing the unified urban and rural construction land market.The research uses methods of grounded theory and statistical analysis of judgements.By summarizing 259 typical judicial precedents in the past two years,this paper analyzes the characteristics,reasons for litigation and causes of disputes in the process of rural collective-owned commercial construction land use right transfer.Results of this study indicate that:(1)the rural collective economic organization transfers the right to use the rural collective land for construction purposes to natural persons or legal persons.(2)The reasons for litigation include the use of the land,the ownership of the land and the validity of the contract.(3)The causes for litigation are the inadequacy of the relevant regulatory system,frequent adjustment of planning;the relative lag of relevant laws and regulations;and the lack of guidelines in the process of transfer transactions.In conclusion,most of the disputes arising from the transfer of collective construction land use rights involve administrative organs,and the improvement of the transfer procedure is a part of the current system construction worth exploring.Furthermore,improving the legal system to ensure that the application of the law is synchronized with social development is an important way to stimulate the vitality of the collective construction land market.
