Innovative Contribution of Xi Jinping’s Important Statements on Legislation

党的十八大以来,以习近平同志为核心的党中央高度重视立法工作。习近平关于立法工作的系列重要论述对马克思主义立法思想的发展作出了创新性贡献。在本体论层面,这些重要论述立足于国家政治活动的宏观视野,深刻回答了“立法是什么”这一基本理论问题,深刻揭示了中国特色社会主义立法的本质;在认识论层面,这些重要论述立基于马克思主义的实践认识论,创造性地提出“法律是治国之重器”“以良法,促善治”“法律是成文的道德,道德是内心的法律”等认识论命题,从法律的辩证关系中揭示法律认知的内在逻辑;在方法论层面,这些重要论述运用马克思主义唯物辩证法,创造性地提出“统筹兼顾”的立法方法论;在价值论层面,这些重要论述强调立法要以人民为中心、守护社会公平正义、引领国家治理现代化,从而深刻揭示了社会主义立法的价值观。

Since the 18th Party Congress of the CPC,the Party Central Committee,with Comrade Xi Jinping at its core,has attached great importance to legislative affairs.Xi Jinping himself has delivered much important discourses on legislation,which has made innovative contributions to the development of Marxist legislative thought.At the ontological level,Xi Jinping has answered the important theoretical question of“what is legislation”based on the macroscopic vision of the political activities of the state,and profoundly revealed the essence of socialist legislation with Chinese characteristics.At the epistemological level,Xi Jinping creatively put forward many propositions including“law is the key instrument of governance,”“good law promotes good governance,”“law is written morality and morality is inner law”based on the epistemology of Marxism.At the level of methodology,Xi Jinping creatively put forward the legislative methodology of“integration and balance”as an application of Marx’s theory historical materialism to the legislative field.At the level of value theory,Xi Jinping emphasizes that legislation should be people-centered approach,help maintain social fairness and justice and guide the modernization of state governance,which profoundly reveals the values of socialist legislation.
