我国“ABS”制度的发展及完善

The Development and Improvement of"ABS"System in China

构建全面“ABS”(Access and Benefit—Sharing)制度(生物遗传资源惠益分享制度)是保护生物多样性的必经之路,在维护我国生物多样性、推动学科发展以及完善法律体系等方面具有重要价值。但我国“ABS”制度存在主管部门不清、知识产权保护力度不够、配套制度空缺等问题亟待解决,提出完善我国“ABS”制度,希望有助于“ABS”制度的有效运行。

The construction of a comprehensive"ABS"(Access and Benefit-Sharing)system(the benefitsharing system of biological genetic resources)is the only way to protect biodiversity.The"ABS"system is of great value in maintaining the biodiversity of our country,promoting the development of the discipline,and perfecting the system of legality,but in our country,there are some problems that need to be solved in the"ABS"system,such as the competent department is unclear,the protection of the intellectual property rights is insufficient and the supporting system is vacant,this paper puts forward the thoughts on perfecting the"ABS"system,aiming at helping the effective operation of the"ABS"system.
