Institutional review and rule of law optimization of environmental binding indicators

环境约束性指标在保护和改善环境、防治污染和其他公害乃至生态文明建设方面发挥着重要作用,且已形成总量约束与质量改善并重的指标体系、政策与法律协同的实施机制、问责与激励并举的考核制度,但同时也存在亟需纾解的结构性、实施性、机制性困境。因此,需要从顶层设计出发推进环境约束性指标的整体规范理念升级,健全指标执行考核评价机制,并探索建立区域协同执行机制,从而预防和避免“按指标治理”异化为“被指标治理”的过度规制悖论。

Environmental binding indicators play an important role in protecting and improving the environment,preventing pollution and other public hazards,and even the construction of ecological civilization,and have formed an index system that places equal emphasis on total constraints and quality improvement,a coordinated implementation mechanism for policies and laws,and an assessment system that combines accountability and incentives,but there are also three dilemmas,such as structure,implementation and mechanism,which urgently need to be alleviated.Therefore,it is necessary to promote the upgrading of the overall normative concept of environmental binding indicators from the top-level design,improve the implementation assessment and evaluation mechanism,and explore the establishment of regional collaborative implementation mechanism,so as to prevent and avoid the excessive regulatory paradox of alienation from“governance according to indicators”to“governance by indicators”.
