Regulation of online aggressive behavior in the post-epidemic era

后疫情时代,在互联网广泛普及的情境下,网络寻衅滋事行为逐渐成为网络“乱象”的祸源之一。由于我国相关的网络规制法律“缺席”,网络空间中寻衅滋事罪的适用问题受到了广泛关注。然而,在现阶段我国的司法实践中,网络寻衅滋事行为的规制仍存在边界模糊、治标不治本等现象。因此,有必要从自由限度要求与公共场所界定两方面来探究寻衅滋事罪在网络空间中的适用问题,并从犯罪主体与犯罪客观方面入手来考察其适用要件,再进一步结合“乌合之众”心理,着眼于网民群体,采取以实名制为基础的随机轻罚制度来完善现有寻衅滋事罪的规定,进一步净化网络空间。

In the post-epidemic era,with the widespread use of the Internet,online provocations have gradually become one of the sources of online "chaos".The application of the crime of picking quarrels and provoking trouble in cyberspace has received widespread attention as a new way to deal with the "absence" of cyber regulation laws in China.However,at this stage of China′s judicial practice,the regulation of online picking quarrels and provoking trouble is still ambiguous and there is a phenomenon of treating the symptoms but not the root cause.Therefore,it is necessary to focus on the application of the crime of picking quarrels and provoking trouble in cyberspace from two aspects,namely,the requirement of freedom and the definition of public places,and to examine the elements of its application from the perspective of the subject of the crime and the objective aspects of the crime.In addition,the existing provisions of the crime of picking quarrels and provoking trouble should be improved by taking into account the psychology of the "rabble" and adopting a random and light punishment system based on real names,so as to further purify the cyberspace.
