Research on Criminal Execution of Pardon System

时至今日,赦免制度已成为社会文明、公众理性、刑罚宽缓的必然选择。人们期待其发挥应有的作用,使之成为国家治理的有益补充。赦免制度执行中,存在特赦适用名单的审查、特赦排除性条款范围厘定、特赦阶段狱内工作、特赦人员的狱外衔接工作等诸多实际问题,因此,有必要关注赦免制度的实践问题,思考并探索赦免制度之完善路径。

Nowadays,the pardon system is not limited by the ruler’s intention to consolidate the political power,but has become the inevitable choice of social civilization,public rationality,and leniency of punish⁃ment.The era of severe law is gone,and what awaits is widespread acceptance of the pardon system and the expectation that it will play its rightful role as a useful complement to national governance.Therefore,to pay attention to and improve the pardon system is not only the needs of national governance,leniency of punishment,but also the protection of human rights.This paper focuses on the current practice of the pardon system,thinking and exploring the way to improve the pardon system.
