我国流域横向生态补偿法律制度完善的立法现状和法治路径

The legislative status and rule of law path of the perfect legal system for cross-basin ecological compensation in China

流域横向生态补偿是明确流域内各区域的权利义务关系、促进上下游协同发展的有效制度。无论是从立法层面或是实践层面来看,我国流域横向生态补偿的发展态势良好。但是我国流域横向生态补偿法律制度依然存在一些规范性问题,可以从科学设置补偿标准、规范横向生态补偿协议、明确生态补偿主体3个路径予以规范。

Transverse ecological compensation in river basins is an effective system that clarifies the rights and obligations of various regions within the basin,and promotes coordinated development between upstream and downstream areas.Whether from the legislative level or the practical level,the development of China's transverse ecological compensation in river basins gains a sound momentum.However,there are still some normative issues with the legal system of transverse ecological compensation in river basins in China,which can be regulated through three paths:setting compensation standards scientifically,standardizing transverse ecological compensation agreements,and clarifying the subject of ecological compensation.
