实质化审理下减刑假释检察监督的优化路径

The Optimal Path of Probation Supervision for Commutation and Parole under the Background of Substantive Trial

减刑、假释实质化审理的关键是检察机关监督职能的发挥,证据材料的严格审查,调查核实权的充分行使,减刑、假释案件特殊诉讼构造的建构。目前司法实践中检察监督面临监督程序“形式化”、监督手段“疲软化”以及监督资源“失衡化”的困境,究其原因是检察机关作为法律监督的主体,法律所赋予的地位直接影响其在监督中的角色扮演、职能发挥及监督成效。在实质化审理的背景下,未来减刑、假释案件检察监督的完善应从源头入手,建立全流程嵌入式检察监督程序,增强监督手段的刚性化效力,精准配置监督资源,从案件类型入手调整监督范围,实现监督队伍专业化,充分发挥“派驻+巡回”监督模式的优势,实现检察监督良性发展。

The key to the substantive trial of commutation and parole is to exert the supervision function of the prosecution services,strictly examine the evidence materials,fully exercise the right of investigation and verification,and construct the special litigation structure of commutation and parole cases.At present,prosecutorial supervision in judicial practice is confronted with the predicament of“Formalization”of supervision procedure,“Weakening”of supervision means and“Imbalance”of supervision resources.The reason is that the status of prosecution services,the subject of legal supervision endowed by law directly affects the role and the effect in supervision.Under the background of substantive trial,the improvement of the prosecutorial supervision of commutation and parole cases in the future should start from the beginning,establish the embedded prosecutorial supervision procedure of the whole process,enhance the rigid effectiveness of supervision means,advance the allocation of supervision resources,change the supervision mode from the case type,realize the specialization of the supervision team,and give full play to the advantages of the supervision mode of“Accredited&Itinerant”.We will achieve sound development of prosecutorial supervision.
