全媒体时代著作权法中的媒体规则及其变革

Media Rules and the Transformation of Copyright Law in the Omnimedia Era

著作权法中存在着诸多媒体规则。随着全媒体发展,传统媒体格局面临变革,融合传播与产业变革的趋势和著作权法中的媒体规则产生内在冲突。为了适应全媒体的发展规律与长期趋势,著作权法应当对立法中的媒体规则体系进行重构,按照技术中立的原则,在著作权权利保护体系、权利限制体系、邻接权体系中实现“去媒体化”。

There are numerous media rules in copyright law.With the devel-opment of the Omnimedia,the competition pattern of the traditional media is fa-cing the change,and the trend of transmission convergence and industrial transfor-mation is in conflict with the media rules in copyright law.In order to follow to the development and long-term trend of Omnimedia,it is necessary to reconstruct the copyright's media rule system。According to the principle of technology neutrality,we need change copyright protection rules,copyright restriction rules and related right rules to make a new copyright law unaffected by media rules.
