元宇宙空间二次创作短视频版权保护的新困境及路径展望

The New Dilemma and Path Prospect of Copyright Protection of Short Video of Second Creation in Metaverse

元宇宙是融合大数据、区块链、虚拟现实、数字孪生等智能技术,实现个体虚拟与现实交融共存的生态空间。去中心化、开放式的生产模式重塑短视频二次创作的生态格局,衍生出新的版权图景,但也带来了合理使用界定模糊、虚拟主体作品难以定性、授权许可模式落后等难题。本文拟从明晰合理使用界定、优化智能合约技术、引入默示许可授权制度三个方面做出相应规制,以期促进元宇宙空间二次创作短视频的版权保护工作,推进元宇宙技术在数字版权领域的可持续发展。

Metaverse is an ecological space that integrates big data,block chain,virtual reality,digital twin and other intelligent technologies to realize the integration and coexistence of individual virtual and reality.The decentralized and open production mode reshaped the ecological pattern of short video secondary creation and derived a new picture of copyright,but it also faced some problems such as vague definition of fair use,difficult to define virtual subject works and backward licensing mode.This paper intends to make corresponding regulations from three aspects:clear definition of fair use,optimization of smart contract technology,and introduction of default license and authorization system,in or-der to promote the copyright protection of short video secondary creation in meta-verse,and promote the sustainable development of metaverse technology in the field of digital copyright.
