摘要 伴随着社会经济的发展,以问题导向为中心,中国法治实践探索出秉持开放性、交叉性、包容性、整合性理念的领域法范式,其对法律规范体系、法学研究与法学教育均产生重大的影响。中国新时代法学学科建设须有效回应领域法对既有部门法范式下的学科体系带来的挑战。领域法以部门法为理论与规范之基础,二者可呈现互促、共进的良性关系。新时代法学学科体系应当有机融合部门法与领域法的双重范式,针对法科学生分类分层设置多元的法学课程,促进法学教育的跨学科交流,完善与课程体系相配套的研究生考核招生机制,培养高质量的复合型法治人才,增强法科学生的就业优势。 With the development of social economy and the problem orientation as the center,China’s rule of law practice has explored the field law paradigm that upholds the concepts of openness,intersections,inclusiveness and integration,which has a significant impact on the legal norm system,legal research and legal education.The construction of law discipline in the new era of China must effectively respond to the challenge brought by the field law paradigm to the disciplinary system under the paradigm of department law.Field law is based on the department law,and the two paradigms can promote each other and progress together.The discipline system of law in the new era should organically integrate the dual paradigms of department law and field law,set up multiple law courses for law students in different categories,promote the interdisciplinary exchange of law education,improve the postgraduate examination and enrollment mechanism matching with the curriculum system,cultivate high-quality compound legal talents,and enhance the employment advantages of law students.
