中国侦查预审功能之实然反思与应然定位

The Realistic Reflection and Orientation of China’s Investigation Pre-trial Function

侦审模式的嬗变均不同程度地背离了侦查预审职能的科学定位,其中将“补充侦查”“深挖余罪”视为侦查预审功能是问题之根本所在。为发挥侦查预审在把控案件质量、引导侦查预审模式选择等方面的作用,有必要从理论、立法和司法实践层面检视当前侦查预审功能的落实现状和问题所在,科学界定侦查预审的应然功能,构建以保障侦查质量为根本,以监督、引导侦查为具体的功能体系;并祛除其“承继侦查”功能。

The evolution of investigation and trial mode deviates from the scientific orientation of investigation and pre-trial function to varying degrees.Among them,it is the root of the problem to regard“supplementary investigation”and“digging deep into the remaining crimes”as the pre-trial function of investigation.In order to give full play to the role of investigation pre-trial in controlling the quality of cases and guiding the choice of investigation pre-trial mode,it is necessary to examine the current implementation status and problems of investigation pre-trial function from the aspects of theory,legislation and judicial practice.And scientifically locate the necessary functions of investigation pre-trial,including establishing the fundamental function of ensuring the quality of investigation and the specific function of supervising and guiding investigation;And,the function of“inherited investigation”should be eliminated.
