党的二十大党章修改对行政法法典化路径的启示

Enlightenment of the Amendment of the 20th Party Constitution to the Codification of Administrative Law

以《中国共产党党章》为核心的党内法规已对当代中国的行政法治产生了重要影响,党章是党的总章程,是“中国之治”的基础规范。党的二十大党章修改,为行政法法典化提供了明确指引:行政法法典化必须坚持和加强党全面领导的根本方向和以人民为中心的根本任务。坚持和加强党全面领导的法典化方向,必须在法典中确立政治领导原则;加强行政法与党内法规组织体系建设的衔接;构建相互补充、互为一体的党政协同治理体系;确立以人民为中心的法典化任务,必须在法典中融入人民至上的行政理念;加强行政法典的民主协商制度建设;打造用权为民的党政协同治理方式;注入优秀传统行政法治文化元素。

The Party Constitution is the general constitution of the Party and the basic norm of"the governance of China".The revision of the Party Constitution by the 20th National Congress of C.P.C.provides clear guidance for the codification of administrative law.By reviewing the historical development and contemporary opportunities of the administrative code⁃this paper points out that the compilation of Chinese administrative code is just in time,and on the basis of discussions about the influence of the party constitution and party laws and regulations on administrative law,puts forward the sugges⁃tion that the code of administrative law should further combines with the revised party constitution,making clear that the codification of administrative law must adhere to and strengthen the fundamental direction of the party’s overall leader⁃ship and take the people as the center of the fundamental task.Specifically speaking,to uphold and strengthen the direc⁃tion of codification under the overall leadership of the Party,it is necessary to establish the principle of political leader⁃ship in the code,strengthen the connection with the organization system of the party and government,construct mutualcomplement and coordinated governance between the Party and the Government,clarify the people’s central position in the codification,integrate the administrative concept of putting the people first,build the collaborative governance mode of the traditional administrative rule of law,create a party-government collaborative governance method that uses power⁃for the people,and input excellent traditional cultural elements of administrative rule of law.
