境外工程项目保函恶意索赔风险防范的探讨

摘要在新冠疫情影响下,我国在“一带一路”沿线国家实施的工程项目风险扩大,保函可能面临恶意索赔风险。文章对境外工程项目保函及独立保函的法律和国际规则适用作了简单阐述,并对后疫情时期保函遭遇恶意索赔的风险因素和应对措施进行了探讨。
