未成年人社区矫正检察监督的困境与对策

Difficulties and Countermeasures of Community Correctional Supervision for Minors

对未成年人进行特殊保护已成为当今社会各界的共识,国家对未成年人罪犯的追责方式也正趋于轻刑化、非刑罚化和非监禁化。自《中华人民共和国社区矫正法》正式施行以来,在“教育、感化、挽救”的原则背景下,如何提升未成年人社区矫正检察监督能力、帮助涉罪未成年人回归社会成为了检察机关必须重视的问题。从未成年人社区矫正工作现状来看,未成年人社区矫正的检察监督工作存在着应矫未矫、监督力量不足、监督效果难以保证、监督专业性欠缺、公检法司协作不足等问题,需要从优化考核指标、整合社区矫正资源、丰富监督方式、总结实践经验和建立多方协作机制等方面进行完善,以应对未成年人社区矫正检察监督的困境,不断加强对未成年人的监督与保护。

Special protection for minors has become a consensus among various sectors of society today,and the country’s accountability methods for juvenile offenders are also tending towards leniency,non punishment,and non imprisonment.Since the official implementation of the Community Correction Law of the People’s Republic of China,under the principle of“education,persuasion,and rescue”,how to enhance the procuratorial supervision ability of juvenile community correction and help juvenile offenders return to society has become a problem that the procuratorial organs must pay attention to.From the current situation of community correction work for minors,there may be problems in the procuratorial and supervisory work of community correction for minors,such as inadequate correction,insufficient supervision force,difficulty in ensuring supervision effectiveness,lack of professional supervision,and insufficient cooperation between public security organs,procuratorates,and legal departments.This article proposes corresponding improvement measures such as optimizing assessment indicators,integrating community correction resources,enriching supervision methods,summarizing practical experience,and establishing a multi-party cooperation mechanism,To better grasp the actual situation of community correction work for minors in the local area,in order to address the dilemma of prosecutorial supervision of community correction for minors,and to strengthen supervision and protection of minors.
