Judicial Reform in Xi Jinping Thought on the Rule of Law

习近平总书记在党的二十大报告中指出“深化司法体制综合配套改革,全面准确落实司法责任制,加快建设公正高效权威的社会主义司法制度,努力让人民群众在每一个司法案件中感受到公平正义”,对司法改革再次作了强调。从体系化视角和整体性思路来看,近年来习近平总书记关于司法改革的系列重要讲话蕴含着对司法改革定性和定位、目标和方向、基本原则和要求、任务和举措的科学认识和重要部署。这些重要论述厘清了新时代司法改革的政治性与人民性、目标导向与问题导向、制约监督权力与保障权利、顶层设计与基层探索、从国情出发与善于借鉴相统一等基础性和前提性问题,是马克思主义法治理论与中国法治实践相结合的最新成果,是我国司法改革创新和发展的重要遵循,对全面推进国家各方面工作法治化、国家治理体系和治理能力现代化水平具有重要的历史意义、政治意义、理论意义和实践意义。

In the report to the 20th National Congress of the CPC,General Secretary Xi Jinping pointed out:“We will deepen comprehensive and integrated reform of the judicial system,fully and faithfully enforce judicial accountability,and accelerate the development of a fair,efficient,and authoritative socialist judicial system.We will see that the people feel justice has been served in each and every judicial case”,and reemphasized the judicial reform.From the perspective of systematization and holistic thinking,General Secretary Xi Jinping’s series of important speeches on judicial reform in recent years contain the scientific understanding and important deployment of the characterization and orientation,objectives and directions,basic principles and requirements,tasks and measures of judicial reform.These important statements clarify the fundamental and prerequisite issues of judicial reform in the new era,such as the unification of political nature and people-oriented nature,the unification of goal orientation and problem orientation,the unification of restriction and supervision of powers and safeguard of rights,the unification of top-level design and grassroots exploration,the unification of starting from national conditions and being good at learning from others,are the latest achievements of the combination of Marxist rule of law theory and Chinese rule of law practice,become the important guidelines for the innovation and development of China's judicial reform,and have significant historical,political,theoretical,practical significance for comprehensively promoting the legalization of all aspects of national work as well as the modernization of the national governance system and governance capacity.
