Analysis of Routine Law Application Problems in Execution Cases

法律适用是办理执行案件的核心环节,法律适用难问题在执行实务中比较突出。我国统一的强制执行法尚未出台,据以办理执行案件的法律规范分散在不同的法律、司法解释和规范性文件当中。为了便于寻法和用法,最高人民法院于2017年编纂了1000条《人民法院办理执行案件规范》,并于2022年进行了系统性的重新编纂,形成了1325条之巨的新规范。从2017年到2022年五年之间发生的巨大变化,是当前办理执行案件需要重点关注的问题。本文聚焦执行申请和受理等十三个问题,对新旧规范变化情况进行梳理和解析,并对适用要点予以提示。

The application of law is the core of handling enforcement cases,while the diffi culty in law application served as a signifi cant and dominating reason for the diffi culty in implementation.The problem is that the legal norms to handle enforcement cases are scattered among diff erent laws,judicial interpretations and normative documents since our country’s consolidated compulsory execution law has not yet been introduced.In order to solve the problem of diffi culty in applying laws in the fi eld of enforcement,the Supreme People’s Court compiled 1,000 regulations on Handling and Enforcement Cases in the People’s Courts in 2017,and systematically revised them in 2022,forming 1,325 new regulations.The great changes in the past fi ve years are the current focus in handling and enforcing cases.This paper focuses on 13 issues such as enforcement application and acceptance,sorts out and analyzes the main situation of the changes before and after,and gives hints to the applicable points for reference in case handling.
