摘要
建设农业强国是全面建设社会主义现代化国家的13个强国战略体系之一,是对未来我国农业发展的新定位。法治是保障农业强国建设方略行稳致远的应然选择。法治的本质要求在于“良法善治”,但目前与建设农业强国相关的法律供给和法律实施均存在不足之处。为此,应当对现行《农业法》等主要涉农法律进行改良修订,适时制订建设农业强国专项法律,完善建设农业强国顶层法制设计。锚定“规范化、职业化、便利化”三方面目标,改进涉农司法和执法。着力推动涉农普法守法,加强涉农法律实施后的监督检查。通过立法、执法、司法、守法这一系列闭环法治举措,保障建设农业强国这项中国式现代化进程中的压舱性任务能持续有序推进。
Building a powerful agricultural country is one of the 13 strategic systems for building a modern socialist country in an all-round way,and is also a new orientation for the future agriculture development in China.The rule of law is an inevitable choice to ensure that the strategy of building a powerful agricultural country is stable and far away.The essence of the rule of law lies in"good law and good governance",but there are some deficiencies in the supply and implementation of laws related to the construction of a powerful agricultural country.Therefore,it is necessary to amend the current agricultural law and other major agricultural-related laws,formulate special laws to build a powerful agricultural country in a timely manner,and improve the top-level legal design of building a powerful agricultural country.The three objectives of"standardization,professionalization and facilitation"should be anchored to improve agriculture-related justice and law enforcement.Efforts should be made to promote the popularization and law-abiding of agriculture-related laws and strengthen the supervision and inspection after the implementation of agriculture-related laws.Through a series of closed-loop legal measures,such as legislation,law enforcement,justice and law-abiding,we can ensure that the ballast task of building a powerful agricultural country in the process of Chinese-style modernization can be carried forward in an orderly manner.
