在全面依法治国背景下,社会主义法治建设对于高素质立法人才的需求与日俱增,高校法学教育被赋予了新的使命,将法律硕士纳入立法人才的培养范围,把立法能力的培育纳入法律硕士人才培养方案具有可行性和时代必要性。高校现有法律硕士培养目标的定位存在局限性,有必要通过向立法实务部门征求意见和建议、合理调整培养方案中的课程设置、改革教育考核方式等措施进行重新定位。对于法律硕士立法能力的培养与提升,可以通过师资结构的优化与完善、实践教学模式的丰富与拓展、专业立法思维的培育与养成等路径来实现。

For a long time,the training goal of Master of Law has been influenced by the concept of judicial centralism,and only focuses on training legal and judicial talents.Under the background of comprehensive rule of law,the demand for high-quality lawmaking talents in the construction of socialist rule of law is increasing day by day.The law education in colleges and universities has been given a new mission.It is feasible and necessary to include the cultivation of legal master in the training scope of lawmaking talents and the cultivation of legislative ability in the training program of legal master talents.There are limitations in the orientation of the current training objectives of legal masters in colleges and universities.It is necessary to re-position them by seeking opinions and suggestions from the legislative and practical departments,reasonably adjusting the curriculum in the training program,and reforming the educational assessment methods;The cultivation and improvement of the legislative ability of the Master of Law can be achieved through the optimization and improvement of the teacher structure;The enrichment and expansion of practical teaching mode;The cultivation and cultivation of professional legislative thinking.
