论个人信息安全保护——基于中国裁判文书网的数据分析

On Personal Information Security Protection——Data analysis based on China judgment document network

目前侵犯公民个人信息的违法犯罪行为多发,个人信息泄露日益严重,不仅危害公民个人的人身财产安全,更影响社会秩序、危害国家安全。通过对中国裁判文书网中侵犯公民个人信息犯罪案件的分析,结合信息时代下个人信息泄露的现状,梳理出民众防范难,个人信息保护职责部门治理难、取证难、监管难的防治困境。本文从个人信息分类分级保护,提升公民个人信息保护意识,规范个人信息安全监督管理,加强对侵犯公民个人信息行为的取证技术的四个方面提出保护个人信息安全的对策,从而立体化、多元化、专业化的防治侵犯公民个人信息的违法犯罪行为。

Currently,there are many illegal and criminal behaviors that infringe on citizens'personal information,and the leakage of personal information is becoming increasingly serious.This not only endangers the personal and property safety of citizens,but also affects social order and endangers national security.Through the analysis of criminal cases of infringing on citizens'personal information in the Chinese Judgment Document Network,combined with the current situation of personal information leakage in the information age,the prevention and control difficulties of public prevention,personal information protection responsibility department governance,evidence collection,and supervision are identified.This article proposes measures to protect personal information security from four aspects:classifying and grading personal information protection,enhancing citizens'awareness of personal information protection,standardizing personal information security supervision and management,and strengthening the forensic technology for infringing on citizens'personal information.This will enable a three-dimensional,diversified,and professional prevention and control of illegal and criminal acts that infringe on citizens personal information.
