制定永定河保护条例必要且可行

Necessary and feasibilities of formulating Regulations for Yongding River Protection

永定河流经山西、内蒙古、河北、北京和天津,是京津冀地区重要的水源涵养区和生态屏障。参考流域和区域保护专门立法的模式制定永定河保护专门条例,是开展流域保护治理、推动绿色协同发展、传承与保护历史文化的法治需要,是统筹流域内山水林田湖草沙一体化保护和系统治理的法治要求。目前该立法已具备政策与法律依据,并具备一定的实践和研究基础。建议立法名称定为“永定河保护条例”,将促进流域生态保护和高质量发展等作为立法目的;设计针对性的监管体制,构建有效的法律制度和机制,针对违法行为设立对应的法律责任。

The Yongding River flows across Shanxi,Inner Mongolia,Hebei,Beijing and Tianjin.As a key ecological barrier for the Beijing-Tianjin-Hebei region,it plays an important role for conservation of water source areas.It is vital to formulate regulations especially for the protection of the Yongding River by learning the experiences of other river basins,in order to strengthen river basin protection and governance,boost green and coordinated development,history and culture inheritance and protection,and conduct integrated protection and systematic governance of mountains,rivers,forests,fields,lakes,grass and sand in the basin.At present,a favorable condition has been created for legislation with certain practical and research practices.It is suggested to name it as Regulations for Yongding River Protection,with the aims of boosting ecological protection and high-quality development of the river basin.A regulatory system shall be designed together with effective legal systems and mechanisms,so as to define corresponding legal responsibilities for illegal acts.
