以东盟ODR机制为借鉴的我国跨境电子商务ODR机制构建

Study on the Construction of ODR(Online Dispute Resolution)Mechanism for China’s Cross-border E-commerce with Reference to ASEAN ODR mechanism

中国电子商务市场规模连续多年位居世界第一,与此同时跨境纠纷也呈爆发式增长。但我国尚未建立跨境电子商务ODR机制,导致消费者跨国维权难的问题。东盟以保护消费者合法权益为首要目标,制定了全面的跨境电子商务消费者保护法律框架和消费者在线争议解决平台,这对我国完善和发展跨境电子商务ODR机制具有重要借鉴意义。因此,我国跨境电子商务ODR应当从构建原则、平台搭建、配套保障、执行机制等方面进行系统化设计,并明确ODR机制的约束性、扩大ODR机制的适用范围、规范ODR程序、保障ODR平台的安全。此外,应在跨境电子商务消费者保护领域广泛开展国际合作,协同保障全球消费者的合法权益,从而为“一带一路”跨境电子商务的发展保驾护航。

The scale of China’s e-commerce market has been ranked first in the world for many consecutive years,meanwhile,cross-border disputes have shown explosive growth.However,due to the lack of an ODR mechanism,it has become difficult for consumers to protect their rights across borders.ASEAN has established a comprehensive legal framework and an ODR platform,with the primary goal of safeguarding the legitimate rights and interests of consumers,which has important implications for the development and improvement of ODR mechanisms.Therefore,China’s ODR should be systematically designed in terms of construction principles,platform constructions,supporting guarantees and execution mechanisms,so as to clarify the constraints of the ODR mechanism,expand the scope of application,standardize ODR procedures and ensure the security of ODR platform.In addition,extensive international cooperation should be carried out to jointly protect the legitimate rights and interests of global consumers,so as to contribute to the development of cross-border e-commerce along the“Belt and Road”.
