牢固树立和践行“两山”理论是实现人与自然和谐共生的必由之路。从三阶层内涵分析,“两山”理论旨在权衡经济发展与环境保护的关系。尽管保护优先原则实现了从政治宣传到法律规范的转化,然而保护优先原则以人类中心主义为视角衡量经济发展与环境保护之间的利益,容易陷入绝对优先的误区。“两山”理论从人与自然和谐发展的视角重新解读环境保护与经济发展的关系以及环境保护对经济发展的积极促进作用,蕴含着系统整体的发展理念,以环境正义为衡量基础,以解释主义方法论为支撑,明确经济发展与环境保护内在统一的辩证关系,深刻揭示生态文明时期不仅要保护好“绿水青山”,也要将“绿水青山”转变为“金山银山”。“两山”理论是生态文明思想的最新成果,对进一步推进环境法律观的发展具有重要意义。

Firmly establishing and practicing the“Two Mountains”theory is the only way to achieve harmonious coexistence between man and nature.From the analysis of the connotation of the three strata,the“Two Mountains”theory aims to balance the relationship between economic development and environmental protection.Although the principle of protection priority has realized the transformation from political propaganda to legal norms,it is easy to fall into the error of absolute priority due to the principle of protection priority measuring the interests between economic development and environmental protection from the perspective of anthropocentrism.The“Two Mountains”theory reinterprets the relationship between environmental protection and economic development and the positive role of environmental protection in promoting economic development from the perspective of harmonious development between man and nature,which contains the concept of systematic and overall development.Based on environmental justice and supported by interpretative methodology,it clarifies the inner unified dialectical relationship between economic development and environmental protection.It profoundly reveals that in the period of ecological conservation,we should not only protect the“lucid waters and lush mountains”,but also transform the“Lucid waters and lush mountains”into“invaluable assests”.The“Two Mountains”theory is the latest achievement of ecological conservation thought,which is of great significance to further promote the development of environmental legal view.
