金融安全视角下的地下钱庄犯罪治理

On the Countermeasures against Underground Banking Crimes under the Perspective of Safeguarding National Financial Security

地下钱庄的存在,不但冲击了我国的金融市场秩序,危害了我国的金融安全,为不法分子提供了资金外流的地下通道,同时还为洗钱、掩饰隐瞒违法犯罪所得、跨境赌博等提供了极大的方便,从而助长了这些跨境犯罪行为。本文从维护国家金融安全的角度,通过分析地下钱庄运作方式,总结地下钱庄的现状和危害,剖析地下钱庄犯罪的侦查困境,进而提出地下钱庄犯罪的治理对策。

The existence of underground banking not only impacts the financial market order in our country,endangering the financial security in China,but also provides an underground channel for illegal elements of capital outflow.Moreover,it provides great convenience for money laundering,concealing criminal gains in law,cross-border gambling,etc.,thus fueling these cross-border crimes.From the perspective of safeguarding national financial security,this paper analyzes the operation mode of underground banks,summarizes the status quo and harm of underground banks,analyzes the investigation predicament of underground banks,and then puts forward the countermeasures of underground banks'crime management.
