集体土地征收的行政自制实践机制:现状考察与完善路径

Administrative Self-control Practice Mechanism of Collective Land Expropriation:Current Situation Investigation and Improvement Path

根据行政自制理论,在集体土地征收领域,行政系统通过内部审批、外部协商、专门督察三个方面形成该理论的实践机制,即土地征收审批程序、非强制性征地补偿安置协议以及专门机关的土地督察。上述三种行政自制实践机制尚不成熟,存在土地征收审批程序内部控权制度闭环自封、征地补偿安置协议缺少实质协商空间以及国家土地督察制度内部监督功能受限等问题。需从优化土地征收审批程序的组织结构与征收主体参与机制、恢复征地补偿安置协议的非强制优势以及加强国家土地督察程序法制化与督察能力建设等方面加以完善,以实现对地方政府土地征收权力的有效控制。

According to the theory of administrative self-control,in the field of collective land expropriation,the administrative system has formed the practical mechanism of this theory through three aspects:internal examination and approval,external consultation and special supervision,namely,the examination and approval procedure of land expropriation,the non-compulsory land expropriation compensation and resettlement agreement,and the land supervision of specialized organs.However,the above three kinds of administrative self-control practice mechanism are not mature,and there are some problems:the closed-loop self-sealing of the internal control system of the land expropriation examination and approval procedure,the lack of substantial negotiation space in the land expropriation compensation and resettlement agreement,and the limited internal supervision function of the state land supervision system.It is necessary to optimize the organizational structure of the land expropriation approval procedure and the participation mechanism of the expropriation subject,restore the non-compulsory advantages of the land expropriation compensation and resettlement agreement,and strengthen the legalization and supervision capacity construction of the national land supervision procedure,so as to realize the effective control of the land expropriation power of local governments.
