诉调对接机制下人民调解在贵州的实践调查研究

Investigation&Research on the Practice of People's Mediation in Guizhou under the Mechanism of Litigation&Mediation

人民调解和民事诉讼是解决民间纠纷的重要方式,在我国基层社会治理中发挥着重要作用。我国基层社会关系经历从“熟人社会”到“陌生人社会”的过渡与变迁,如何在“陌生人社会”创新基于“熟人社会”传统下发展起来的民间调解方式,是基层社会治理中需要面对和解决的问题。文章以人民调解在贵州的实践状况为基础,对民事案件的诉讼方式和民间纠纷的人民调解情况进行对比,分析贵州民事诉讼和人民调解解纷的现状,提出加大人民调解的普法宣传,加强人民调解队伍的专业化建设,提升人民调解为民服务水平的建议,以推动人民调解在贵州向纵深发展。

People's mediation and civil litigation are important ways to resolve civil disputes,and play an important role in China's grass-roots social governance.The transition and change of grass-roots social relations from"acquaintance society"to"stranger society",and how to innovate the folk mediation methods based on the tradition of"acquaintance society"in the"stranger society",are the problems that need to be faced and solved in grass-roots social governance.Based on the practice of people's mediation in Guizhou,this paper makes a comparative analysis of the civil case litigation and the people's mediation of civil disputes and proposes to increase the publicity of people's mediation,strengthen the professional construction of people's mediation team,improve the level of people's mediation serving the people,and promote the in-depth development of people's mediation in Guizhou.
