整合与共治:“软法”与“硬法”在乡村振兴中的互动机制研究

Integration and Co-governance:Study on the Interaction Mechanism of“Soft Law”and“Hard Law”in Rural Revitalization

在乡村振兴的时代背景下,提升乡村现代化治理能力显得尤为关键。“软法”一经问世,便对传统意义上的“硬法”范式释放出颠覆性的影响力。在乡村治理体系现代化进程中,“软法”与“硬法”各自遵循“自下而上”与“自上而下”的行动逻辑,扮演着不可或缺的重要角色。通过揭示“软法”与“硬法”在乡村振兴中的存在方式、运行机理及其适用领域,不难发现二者在一定程度上能够实现“共生”。通过解读生物界的“共生理论”,可以将其作为对“软法”与“硬法”的“契合度论证”的理论支撑。面向未来,在乡村振兴的时代要求下,应该打破传统意义上的“硬法”为王局面,进一步拓宽“软法”的运作路径,构建“软法”与“硬法”的转化共存机制,实现对二者的“整合”与“共治”,为乡村振兴筑牢法治之基。

In the era of rural revitalization,it is particularly critical to improve the ability of rural modernization governance.Once the“soft law”came out,it released a subversive influence on the traditional“hard law”paradigm.In the modernization process of rural governance system,“soft law”and“hard law”respectively follow the action logic of“bottom-up”and“top-down”,and play an indispensable role.By revealing the existence mode,operation mechanism and application field of“soft law”and“hard law”in rural governance,it is not difficult to find that the two can achieve“symbiosis”to a certain extent.By interpreting the“symbiosis theory”in the biological world,it can be regarded as the theoretical support for the“fit argument”between“soft law”and“hard law”.It will be conducive to enhancing China’s rural social governance capacity and building the foundation of rule of law for rural revitalization to face the future,break the situation of traditional“hard law”as the king to meet the requirements of the era of rural revitalization,further expand the operation path of“soft law”,construct the transformation coexistence mechanism of“soft law”and“hard law”and realize the“integration”and“co-governance”.
