构建我国社区家事纠纷解决机制的可行性研究

A Feasibility Study on Constructing the Settlement Mechanism of Community Family Disputes in China

随着我国司法体制的改革,多元化纠纷解决机制成为纠纷解决的必然选择,综合治理成为社会治理的基本战略。家事纠纷的身份性、情感性决定了应当为家事纠纷提供一种单独的非诉讼纠纷解决机制——社区家事纠纷解决机制。社区是解决家事纠纷的第一道防线,是家事纠纷调解的“本土资源”,社区分布广、数量多,运行成本低,可极大节约社会成本,减轻法院压力,具有解决家事纠纷的独特优势。同时,我国具有社区解决家事纠纷深厚的历史和文化基础,近年来我国各地试点成立了专门社区家事纠纷服务中心的实践探索,也为构建社区家事纠纷解决机制奠定了良好的实践基础。因此,我国目前构建社区家事纠纷解决机制,不仅是现实的、必要的,同时也是可行的。

With reform of Chinese judicial system,the diversified dispute resolution mechanism has become an inevitable choice for dispute resolution,and comprehensive governance has become the basic strategy for social governance.The identity and emotion of family dispute decide that we should provide a separate non-litigation dispute resolution mechanism for family dispute-a community family dispute resolution mechanism.Community is the first defense line to solve family disputes,and is the“local resource”for family dispute mediation.Community is widely distributed,large in number,low in operation cost,can greatly save social costs,reduce the pressure of the court,and has unique advantages to solve family disputes.At the same time,China has a deep historical and cultural foundation for community family dispute resolution.In recent years,China has set up special community family dispute service centers,which have laid a good practical foundation for the construction of community family dispute resolution mechanism.Therefore,the establishment of community family dispute resolution mechanism is not only realistic and necessary,but also feasible in China.
