游戏直播平台的反垄断规制研究

摘要 游戏直播产业自兴起以来,快速实现了市场的稳定化和寡头化,对其的反垄断规制势在必行,但是互联网平台经济的独特属性导致反垄断规制有别于传统领域;同时直播平台的垄断行为和版权刑事行为相互交杂,给垄断行为认定带来额外的困难。对此,应当建立更加完善的监管机制,使得反垄断工作能够跟上直播市场发展速度;应当构建多元化的相关市场、市场支配力的认定标准体系,以适应直播市场的特殊性要素;同时可以借鉴“必要设施”理论和“相对垄断地位”理论,对版权行使与垄断行为做出更清晰的界分。 Since its emergence,the live game industry has rapidly realized market stabilization and oligopolization,and it is imperative to regulate its antitrust.However,due to the unique attributes of the Internet platform economy,the anti-monopoly regulation is different from the traditional field.At the same time,the monopolistic behaviors of live streaming platforms and the criminal behaviors of copyright in-termingle,which brings additional difficulties to the identification of monopolistic behaviors.In this regard,a more perfect regulatory mecha-nism should be established so that the anti-monopoly work can keep up with the development speed of the live streaming market.In order to adapt to the special elements of the live broadcast market,the identification standard system of diversified relevant markets and market power should be constructed.At the same time,we can draw lessons from the theory of“necessary facilities”and the theory of“relative mo-nopoly position”to make a clearer distinction between copyright exercise and monopoly behavior.
