摘要
调解与审判在思维模式、法理价值、运行程序等方面存在巨大差异,导致调审合一模式下,“以劝压调”“以拖压调”“以诱促调”等现象层出不穷。在最高人民法院的指导下,各地法院分别在程序设置、人员安排等方面进行调审分离模式探索。但实践中仍存在诉讼效率低下、程序冗长、考核机制不合理等弊病,通过确立专职调解员制度,妥善安排诉讼与调解的程序衔接,调整考核机制,探索符合中国实际发展状况的调审模式。
There are huge differences between mediation and trial in terms of thinking mode,legal value,operating procedures,etc.,resulting in the phenomena of“adjusting by persuasion”,“adjusting by drag”and“adjusting by inducement”under the unified mode of mediation and trial.Under the guidance of the Supreme People’s Court,local courts have explored the mode of separation of mediation and trial in terms of procedure setting and personnel arrangements.However,in practice,there are still disadvantages such as low efficiency of litigation,lengthy procedures,and unreasonable assessment mechanism.Through establishing a full-time mediator system,properly arranging the connection of litigation and mediation procedures,adjusting the assessment mechanism,this paper explores a mediation and trial model that meets the actual development of China.
