摘要
当前我国民用船舶国防动员已形成了国防改造、征用补偿以及组建战略投送支援船队三种模式并行的局面。为解决民用船舶国防动员机制中过于强调军事利用的强制性、缺乏平等协商契约型机制的困境,从行政私法理论这一研究视角审视我国船舶国防动员机制。分析民用船舶国防动员机制与行政私法理念的契合性,得出推进民用船舶国防动员机制改革的法律进路在于探索民用船舶国防动员合同的成型、配套法规的健全以及动员机制中融入“协商-合作”程序规制,为民船的国防动员构建全方位的法律保障。
Currently,the national defense mobilization of civil ships in China has formed a parallel situation of three modes:national defense transformation,requisition compensation,and the establishment of strategic delivery support fleets.In order to solve the dilemma of overemphasizing the mandatory use of military resources and lacking an equal negotiation contract mechanism in the mobilization mechanism for civil ship defense,China's ship defense mobilization mechanism is examined from the perspective of administrative private law theory.By analyzing the compatibility between the national defense mobilization mechanism of civilian ships and the concept of administrative private law,in order to build a comprehensive legal guarantee for the civil ship defense mobilization of civilian ships,legal approach to promoting the reform of the civil defense mobilization mechanism for the civil ships lies in exploring the formation of the civil ship national defense mobilization contracts,the improvement of supporting laws and regulations,and the integration of "consultation cooperation" procedural regulations into the mobilization mechanism.
