民族地区传统村落保护与发展地方立法的新路径

On the New Path of Local Legislation for the Protection and Development of Traditional Villages in Ethnic Regions

民族地区传统村落保护、利用与发展矛盾突出,面临衰败空心化、保护规划错位、发展不足、过度开发等深层次困境。民族地区传统村落保护与发展的地方立法存在传统村落概念狭窄、保护与发展目标缺失、保护与发展原则失衡、保护与发展模式利益偏颇、铸牢中华民族共同体意识内容缺失等矛盾问题。民族地区传统村落保护与发展的地方立法应根据全面推进乡村振兴的新理念,在强化铸牢中华民族共同体意识主线、保护与发展范围整体化、保护与发展目标系统化、保护与发展原则平衡化、保护与发展模式可持续性等方面创新,维持民族地区传统村落的完整性、真实性和延续性,实现民族地区传统村落文化遗产有效保护、资源合理利用,推进其社会结构与功能的完善与提升。

Having serious contradictions between protection,utilization and development,traditional villages in ethnic regions are faced with deep-rooted difficulties such as decline and hollowing out,misplaced protection planning,underdevelopment and overexploitation.The local legislation on the protection and development of traditional villages in ethnic regions has such contradictions as narrow concept of traditional villages,lack of protection and development goals,imbalance of protection and development principles,biased interests of protection and development mode,and lack of content to consolidate the sense of community for the Chinese nation.In accordance with the new concept of comprehensively promoting rural revitalization,the local legislation on the protection and development of traditional villages in ethnic regions should be innovative in the aspects of strengthening the main line of consolidating the sense of community for the Chinese nation,integrating the scope of protection and development,systemizing the protection and development goals,balancing the principles of protection and development,and sustainable protection and development mode,and maintain the integrity,authenticity and continuity of traditional villages in ethnic regions,so as to realize effective protection of cultural heritage,rational utilization of resources,and high-quality development of social structure and function of traditional villages in ethnic regions.
