在数字技术快速发展的背景下,世界经济正在被物联网、大数据、区块链等第四次工业革命的新型数字技术所重塑,数字经济呈现爆炸式增长,随之而来的数字经济争端也愈加频繁和复杂。(1)RCEP作为成员方最多元、发展潜力最大的区域自由贸易协定,是东亚区域合作的标志性成果和里程碑事件,但其争端解决机制无法高效、有效、妥善处理数字经济纠纷。数字经济争端的妥善解决对协定实施尤其重要,其不仅有利于保障争端方依条约所享权利的实现,也是全球数字经济治理法治化的具体呈现,故要专门构建RCEP数字经济争端解决机制,一方面确保数字经济争端高效、透明地解决,通过灵活性、适应性的程序设计使数字经济争端在实体规则缺失的情况下最大限度化解,另一方面发挥法律手段的价值引导功能,为争端解决提供标准化方案和先行示范,促进数字经济的良性、健康、持久发展,对受数字浪潮冲击的全球经贸发展作出回应。

Against the backdrop of rapid development of digital technology,the world economy is being reshaped by new digital technologies such as the Internet of Things,big data,blockchain,and the fourth industrial revolution.The digital economy is showing explosive growth,and the accompanying digital economic disputes are becoming increasingly frequent and complex.As the most diverse and promising regional free trade agreement among member countries,RCEP is a landmark achievement and milestone event in East Asian regional cooperation.However,its dispute resolution mechanism cannot efficiently,effectively,and properly handle digital economy disputes.The proper resolution of digital economy disputes is particularly important for the implementation of the agreement.It is not only conducive to ensuring the realization of the rights enjoyed by the parties to the dispute under the treaty,but also a concrete manifestation of the rule of law in global digital economy governance.Therefore,it is necessary to establish a dedicated RCEP digital economy dispute resolution mechanism to ensure efficient and transparent resolution of digital economy disputes through flexibility Adaptive programming allows for the maximum resolution of digital economy disputes in the absence of substantive rules.On the other hand,it plays the value guiding function of legal means,providing standardized solutions and leading demonstrations for dispute resolution,promoting the healthy,sustainable development of the digital economy,and responding to the global economic and trade development impacted by the digital wave.
