摘要
法官员额制改革是全面深化司法改革的重要举措,是实现司法公平的重要保障。对员额制改革的研究,可从法官的自我实现与实现自我的角度切入。法官的自我实现是在遵守司法审判规律和社会历史发展规律的基础上,是个体自我实现与群体自我实现的统一,是主观能动性得到充分彰显后主体性获得的承认。法官的自我实现是实现自我的目标,实现自我是自我实现的目的。“行政控制型”和“法官自治型”关系模式都存在各自的不足,“法院整体本位”关系模式能够推动法官实现自我与实现司法公正目的的达成,为此需要进一步完善法官实现自我的内化激励机制、履职保障机制和回应型治理机制。
The reform of judicial system for specified number of judge personnel is an important measure to comprehensively deepen the judicial reform and an important guarantee to achieve judicial fairness.The research on this can be carried out from the perspective of self-realization and realizing oneself of judges.On the basis of observing the rule of judicial trial and the rule of social and historical development,the self-realization of judges is the unity of individual self-realization and group self-realization,and the recognition of subjectivity after the subjective initiative is fully demonstrated.The self-realization of judges is the target of realizing oneself,and realizing oneself is the goal of self-realization.The relational modes of“executive control”and“judge autonomy”both have their shortcomings,and the relational mode of the“holistic standard of the court”can promote both the self-realization of judges and the achievement of judicial fairness.Therefore,it is necessary to further improve the internal incentive mechanism of realizing oneself of judges,the guarantee mechanism of duty execution and the governance mechanism of response type.
