近年来,中国高度重视数据要素及其市场化配置改革,从战略高度提出要“加快培育发展数据要素市场”。2022年6月,《关于构建数据基础制度更好发挥数据要素作用的意见》中提出,要完善数据全流程合规和监管规则体系,建设规范的数据交易市场。数据交易市场的建设推进依赖数据全流程合规管控,数据交易合规性审查是保障数据交易流程合规的重要手段之一,目前已在多个省市的数据交易中心中推进开展。该报告中主要分析了国际国内在数据交易合规管控上的开展情况,通过研究典型法规制度对数据交易合规管控的要求,梳理数据交易合规审查要点与内容,并对数据交易合规审查工作实施提出意见建议。

In recent years,China has attached great attention to the reform of data elements and their market-based configuration,and proposed to accelerate the cultivation and development of data element markets from a strategic perspective.In June 2022,in the Opinions on Building a Regulation System to Better Stimulate the Vitality of Data Elements,it proposed to improve the system of compliance and regulatory rules in the whole data process and build a standardized data trading market.The construction and promotion of the data trading market rely on the compliance control in the whole data process,and the compliance review of data trading is one of the most important means to ensure the compliance of the data trading process.It has been promoted in the data trading institutions in many provinces and cities.This report mainly an-alyzes the development of data trading compliance control from both international and domestic view,sorting out the key points and contents of data trading compliance review by studying the requirements and regulations of typical laws.It puts forward suggestions on the implementation of data trading compliance review.
