Rational Examination and Rule Repair of Online Litigation in Criminal Cases

在刑事司法领域,在线诉讼的出现完美契合司法实用主义的价值理念。在线诉讼突破了物理空间的限制,顺应了智慧司法的时代潮流,但其相较于传统线下庭审仍面临理论上的正当性拷问。囿于当前在线诉讼规则抽象化的局限性,刑事案件在线诉讼的程序运行中存在着诸如在线诉讼适用范围有限、当事人程序选择权保障机制不健全以及线上线下程序转化机制缺失等问题。从在线诉讼规则的立法完善角度考量,立法机关须科学厘定在线诉讼适用范围,健全在线诉讼当事人程序选择保障机制,充分尊重和保障当事人的程序选择权;完善刑事案件在线诉讼法庭规则与优化线上线下程序衔接机制,实现审判公正与审判效率的平衡。

rules of online litigation,there are some problems in the procedure operation of online litigation in criminal cases,such as the limited application scope of online litigation,the imperfect guarantee mechanism of the parties'procedural options and the lack of online and offline procedure transformation mechanism.From the perspective of legislative perfection of online litigation rules,the legislature should scientifically determine the scope of application of online litigation,improve the safeguard mechanism of online litigation parties'procedural choice,and fully respect and protect the parties'procedural choice;We should improve the rules of online court proceedings in criminal cases and optimize the connection mechanism between online and offline procedures to achieve the balance between trial justice and trial efficiency.
