党内法规法典化的实践路径探讨

当前党内法规法典化的研究虽已在必要性和可行性上达成初步共识,但还缺乏对具体实践路径的进一步论证,而这有赖于对党内法规法典化实践效用与实践原则的充分思考以及微观而非宏观的论证视角。党内法规法典化只能是一种实质上的体系型的法典化而非汇编型的法典化,这一概念的明确可以加深对党内法规法典化实践效用的理解。党内法规法典化实践原则是实践路径所依据的法则和标准,循序渐进原则、非排他原则、体系性与安定性原则的确立为实践路径的微观探讨提供了可靠的支撑,进而可以得出以下结论:党内法规法典化要经过从汇编到法典的历程,重视执纪执法实践工作对法典化的补益,将程序性内容与实体性内容分开,选择相对成熟的领域优先启动。

At present,the research on the codification of Party regulations has reached a preliminary consensus on the necessity and feasibility,but there is still a lack of further demonstration of the specific practical path,which depends on the full consideration of the practical utility and principles of the codification of Party regulations and the micro rather than macro perspective of demonstration.The codification of Party regulations can only be a kind of systematic codification in essence rather than a compilation of codification,and the clarification of this concept can deepen the understanding of the practical effectiveness of the codification of Party regulations.The practice principle of codification of Party is the rule and standard on which the practice path is based,and the establishment of the principles of gradual progress,non-exclusiveness,systematicness and stability provides a reliable support for the micro-discussion of the practice path.The following conclusions can be drawn:the codification of Party regulations should go through the process from compilation to codification,attach importance to the benefits of the practice of discipline enforcement to codification,separate the procedural content from the substantive content,and select relatively mature areas to start first.
