Research on the Rationality of Administrative Procedures

理性的行政程序要求其在制度设计及运行中必须遵循行政法治的精神,注重行政相对人权益保护,以追求效率作为内在价值等。实践中将行政程序虚无化、绝对化、脱节化和苛刻化都是非理性表现。为此,应当合理定位行政程序,把它作为工具性要素附着于公平价值;通过行政程序典则化,对目前分散的行政程序规则予以整合并进一步规范;设计行政相对人及其他利害关系人深度参与的行政程序规则;建构行政程序运行的监督体制机制,以矫正非理性行政程序;将行政程序运行的效果和结论交于司法程序最终裁判。

The rational administrative procedure requires that its system design and operation must follow the spirit of administrative rule of law,focus on the protection of the rights and interests of administrative counterparts,and pursuit efficiency as the intrinsic value.In practice,the nihilization,absolutism,disconnection and harshness of administrative procedures are irrational manifestations.To this end,the administrative procedure should be reasonably positioned and attached to the value of fairness as an instrumental element.The rules of administrative procedure should be integrated and further standardized through the canonization of administrative procedure.The rules of administrative procedure should be designed for the in-depth participation of administrative counterparts and other stakeholders.The institutional mechanism for the supervision of administrative procedure should be constructed to correct the irrational administrative procedure.The effects and conclusions of the operation of the administrative process are left to the final judgment of the judicial process.
