论区域协同立法功能定位及其实现

On the Positioning of Regional Synergy Legislation Function and Its Implementation

学界对区域协同立法制度已有诸多研究,但鲜有文献对区域协同立法的功能定位开展专门研究。关于协同立法功能性质,理论研究长期存在将区域协同的“国家政策”视作“立法功能”的认识误区,给协同立法理论与实践工作带来困惑。区域协同立法功能定位的界定,应坚持以国家政策为指引,以《地方人大组织法》所确立的“区域协同发展的需要”为前提,明晰地方协同立法权限范围,并将区域协同立法功能界定为推进“区域市场一体化”的基本方向。围绕上述区域协同立法功能,区域协同立法机关应在“功能最适原则”指引下,针对法制资源整合、利益协调、社会统筹等领域分别采取相适应的立法策略,包括完善优化区域利益分配机制、分步推进区域公共服务均等化等具体方式,来加速推进区域协同立法纵深发展。

Many studies have been conducted on regional collaborative legislation system,but there is little literature on the functional orientation of regional collaborative legislation.As for the nature of the function of collaborative legislation,there is a long-standing misconception in theoretical research that the“national policy”of regional collaboration is regarded as the“legislative function”,which brings confusion to the theoretical and practical work of collaborative legislation.To define the function of regional synergistic legislation,we should insist on national policy as the guide,take the“need of regional synergistic development”established by the Organic Law of Local People’s Congress as the premise,clarify the scope of local synergistic legislation authority,and define the function of regional collaborative legislation as the basic direction to promote“regional market integration”.With respect to the above-mentioned functions of regional synergistic legislation,the regional synergistic legislature should adopt appropriate legislative strategies for the integration of legal resources,coordination of interests and social integration under the guidance of the“principle of optimal functions”,including improving and optimizing the mechanism of regional interest distribution and promoting the equalization of regional public services in a step-by-step manner,so as to accelerate the deep development of regional synergistic legislation.
