新《著作权法》视阈下体育赛事节目版权属性再思考

Rethinking on the Copyright Attribute of Sports Event Programs from the Perspective of the New Copyright Law

面对新技术、新时代下的产业变革与利益争端,体育赛事节目版权属性问题引发诸多法律纠纷。新《著作权法》视域下,独创性的判断标准仍存在模糊之处,但其中新增的“视听作品”为体育赛事节目独创性判断提供了新的参照系;对视听作品的定义与归属进行综合分析,可以认定体育赛事节目属于视听作品,且可以参照美国法“视为作者”原则对体育赛事节目的归属进行划分,同时辅之以著作权合同,达到不同主体间的利益平衡,为体育赛事产业高效益发展提供更为全面的法律保障。

In the face of new technology,new era of industrial change and interest disputes,sports program copyright issues caused many legal disputes.This paper studies and demonstrates the copyright related issues of sports event programs one by one,and draws the following conclusions:from the perspective of the new copyright law,the judgment standard of originality is still vague,but the new"audio-visual works"in the new copyright law provides a new reference system for the judgment of originality of sports event programs;In addition,through a comprehensive analysis of the definition and attribution of audio-visual works,it can be concluded that sports events belong to audio-visual works,and the attribution of sports events can be divided according to the principle of"regarded as the author"in the common law system.At the same time,the copyright contract can be supplemented to achieve the balance of interests between different subjects,so as to provide a more comprehensive guarantee for the development of sports events industry.
