摘要
本研究对植物专利保护问题进行了探析,旨在优化相关政策以促进转基因植物的合法保护。研究结果提出了以下主要观点:首先,应优化植物新品种保护条例,将转基因植物保护融入其中,并加强植物新品种保护法律地位,以确保转基因植物得到适当保护。其次,为了实现品种保护和专利保护的并存,建议在过渡期发展中明确将转基因植物纳入专利保护范畴,并将专利保护与植物新品种保护相结合,减少权利者费用支出。最后,为建立完善的专利保护方式,需要推行“单轨制”专利保护方式,并对转基因植物研发投资者的权利进行约束,以保障遗传资源提供方的权益。本研究提供的植物专利保护政策优化的建议,旨在为中国转基因植物的合法保护和可持续发展提供支持。然而,未来仍需进一步研究和完善相关政策和法律制度,以应对不断发展的需求和挑战。
This study examines the issue of plant patent protection and aims to optimize relevant policies to facilitate the legal protection of genetically modified plants.The research findings propose the following key points:Firstly,it is necessary to optimize the regulations on the protection of new plant varieties by incorporating the protection of genetically modified plants and strengthening the legal status of plant variety protection to ensure adequate protection for genetically modified plants.Secondly,in order to achieve coexistence of variety protection and patent protection,it is recommended to include genetically modified plants within the scope of patent protection during the transitional period.Patent protection should be combined with the protection of new plant varieties to reduce costs for rights holders.Lastly,to establish an effective patent protection system,the implementation of a"single-track"patent protection approach is suggested.Additionally,constraints should be placed on the rights of investors in genetically modified plant research and development to safeguard the interests of providers of genetic resources.The policy optimization recommendations provided in this study aim to support the legal protection and sustainable development of genetically modified plants in China.However,further research and improvement of relevant policies and legal frameworks are still needed to address evolving needs and challenges.
