网络黑产遍布在网络经济产业的互联网金融、电商平台、网络游戏等诸多领域,涉及面广,形成了完整的流水化作业链条。网络黑产违法案件的频发,增加了网络企业的安全防护成本,破坏了正常的市场竞争秩序,侵犯了用户的合法权益。在总结网络黑产类型和犯罪特点基础上,剖析了治理过程中存在法律不完善、作案手段隐蔽、取证难等难点和困境,归纳了不良市场需求、监管力度不足等网络黑产泛滥的原因,有针对性地提出了完善相关法律法规、增强技术防范能力、加强网络黑产的监管、构建多元化的治理模式、增强宣传教育力度等治理路径。

The Network Dark Industry Link is spread in many fields such as internet finance,e-commerce platforms,online games and so on in the network economy industry,covering a wide range,forming a complete streamlined operation chain.The frequent occurrence of illegal cases of illegal production on the Internet has increased the cost of security protection of network enterprises,destroyed the normal market competition order,and violated the legitimate rights and interests of users.On the basis of summarizing the types and criminal characteristics of cyber crime,this paper analyzes the difficulties and dilemmas existing in the process of governance,such as imperfect laws,covert means of committing crimes,and difficulties in obtaining evidence,summarizes the reasons for the proliferation of cyber crime,such as bad market demand,inadequate supervision,etc.,and proposes to improve relevant laws and regulations,enhance technical prevention capabilities,strengthen the supervision of cyber crime,build a diversified governance model,and strengthen publicity and education.
